Former Police Chief Philippe Bisset was actually “fired in disguise” by the City of Montreal. The Principal did not appeal in time; So the court dismisses his case.


That’s what Judges Nathalie Solifor, Scott Hughes and Steve Cunart decided in a decision handed down in late June.

The judges wrote that “Mr. Pichet was actually fired in disguise” by the city of Montreal.

It is unfortunate that Mr. Bichet […] Left to his own devices, neither more nor less abandoned.

However, Justice Mr. Pichette’s lawsuit was dismissed because it was not filed within the time limit provided by law. We can read that “Mr Pichet’s appeal, subject to too short a time limit, is belatedly instituted and must therefore be dismissed”.

He had only one month to file the suit after a month of his dismissal. “In the absence of a municipal resolution and notification of a termination decision, knowledge of being in a termination situation triggers the 30-day period,” the ruling explains.

Mr. Bichet has decided to contest the decision, even if it proves him right on the merits. Rejecting the SPVM’s former chairman’s claim that the complaint was filed too late, his lawyers also filed a judicial review request.
